Terms of Service

These terms govern your use of PsychProof. By using our platform, you agree to these conditions designed to protect the integrity of your compliance records and our service infrastructure.

Billing & Annual Commitment

PsychProof operates on an annual-only billing cycle. To ensure the continuity and integrity of your WHS records, we do not offer monthly subscriptions.

  • Non-Refundable: Annual fees are paid in advance and are strictly non-refundable once the 14-day trial period has ended.
  • Annual Cycle: Your commitment is for a full 12-month period from the date of your first payment following the trial.
  • Cancellation: You may cancel your subscription at any time; however, access will continue until the end of your current paid annual term. No pro-rata refunds are provided.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

14-Day Free Trial

New accounts are eligible for a 14-day full access trial. During this period, you may explore all features of the selected plan. If you do not cancel before the trial ends, your chosen payment method will be automatically charged for the annual plan in full.

Custodian Mode & Record Retention

WHS regulations often require records to be kept for up to 7 years. If you choose not to renew your active subscription, PsychProof offers an optional "Custodian Mode."

For a reduced annual maintenance fee, Custodian Mode allows you to maintain your "Independently Witnessed" evidence trail in a "read-only" state. This ensures you can still produce records for inspectors or auditors without maintaining a full active management plan. If you do not opt for Custodian Mode or renewal, your records will be handled according to our standard data deletion policies.

Record Integrity & Immutability

To support your duty of care, PsychProof implements cryptographic hash-chaining. By using this service, you acknowledge that certain risk records and timestamps are immutable (cannot be edited or deleted) once sealed by the system. This is a deliberate security feature intended to ensure your records are defensible in a court of law or regulatory audit.

Service Limitations

PsychProof is a SaaS record-keeping tool. We do not provide legal, WHS, or psychosocial risk management advice. You are responsible for ensuring that your use of the platform and the actions you document are sufficient to meet your specific legal obligations under Australian WHS law.

Intellectual Property & Feedback

All rights, title, and interest in and to the PsychProof platform, including but not limited to software, algorithms, and interface design, remain the exclusive property of PsychProof.

User Feedback: If you provide any suggestions, enhancement requests, or other feedback regarding our services, you grant PsychProof a royalty-free, worldwide, transferable, sub-licensable, irrevocable, perpetual license to use or incorporate that feedback into our services without obligation.

Limitation of Liability

To the maximum extent permitted by law, PsychProof's total liability for any claim arising out of or relating to these Terms or the Use of the Service, whether in contract, tort, or otherwise, shall be limited to the total amount of fees paid by you to PsychProof during the 12 months preceding the event giving rise to the claim.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree that the courts of Queensland have exclusive jurisdiction over any dispute arising under or in connection with these Terms.
